Terms and Conditions

Use of this site

Customers must be 18 years old to use this site. If you are under 18, you may only use the site in conjunction with or under the supervision of a parent or guardian who is over 18 years of age. You agree that e-mail will be used as the primary long-distance means of communication.
Losoftware does not accept liability for any errors and omissions within this website and reserves the right to change information, prices, specifications and descriptions of listed goods, products and services.
You may not copy, edit or link to any section of www.losoftware.co.uk without the express, written permission of Losoftware.

Processing of orders

No contract between you and Losoftware will exist until Losoftware accepts your order and confirms its receipt in writing.
Losoftware aims to deliver all goods within 7 days of receiving your order. However your order may be delayed should an item or component material be out of stock. In this event we will keep you updated by e-mail as to the status of your order. Please note that orders for two or more items may be delivered as part orders should one or more of the items be unavailable.
You must check that the details on any confirmatory e-mail you receive immediately to confirm they are correct. If any of the details are incorrect, it is your obligation to contact Losoftware at your earliest opportunity for the necessary amendments to be made. Losoftware will not be liable for any items shipped in error where the goods shipped and the shipping address used are in accordance with those listed within the confirmation e-mail.
You undertake that all details you provide to Losoftware for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.

Copyright

It is assumed that any material submitted to Losoftware is by the original copyright holder or permission has been given by the copyright holder to digitise or reproduce said material. Losoftware accepts no liability for any subsequent litigation which may result.

Payment

We accept most types of payment, Visa, MasterCard and Switch via PayPal. Your order will only be processed subject to payment being authorised. Please note that the payment transaction will take place prior to delivery.
All prices are inclusive of VAT, unless otherwise stated.
If an error is discovered in the price of the goods that you have ordered, Losoftware will inform you of the correct price as soon as possible. In this event Losoftware shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. We shall give you the option of confirming the order at the correct price or if you so choose, to cancel the order and a full refund will be issued.

Cancellation of Order

You are able to cancel your order within 36 hours of placing your order on the website providing we have not already processed it. If you wish to cancel your order, you should do so by email. Please ensure you quote your name, address and order reference number in all communications.

Fitness of product use

Losoftware does not guarantee any product's fitness for a particular purpose. All items are listed on an 'as is' basis.

Trade Descriptions Act

Every care has been taken to ensure that the descriptions, pictures and specifications are correct. All dimensions are approximate and while we make every effort to reproduce colour accurately there may be slight colour variations that occur.

Privacy Policy

We collect your personal information in order to provide you with the best possible service. The type of personal information includes, your Name, Address, Telephone number, e-mail address.
We will never collect sensitive information about you or any payment information without your consent. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). The information we hold will be accurate and up to date as far as possible. If you find any inaccuracies please inform us and we will correct it as soon as possible. The personal information, which we hold, will be held securely in accordance with our internal security policy. If you have any questions/comments about privacy, you should contact us by email and we will endeavour to reply within 2 working days.

Limitation of Liability

This liability section applies only to the extent permitted by law. Except as set out below, neither Losoftware nor any of their directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site.
Losoftware does not accept liability (except as set out below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
Losoftware does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use of the website or for any products purchased from Losoftware website.
Losoftware shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
Losoftware will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.

Illegal Acts

It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. We track the electronic 'fingerprints' of every order placed to enable us and all legitimate crime prevention and prosecution authorities, to trace individual users engaging in criminal activities on our website.

Governing Law

Purchases from Losoftware are subject to English Law.

Modification of Terms

Losoftware reserves the right to modify these terms and conditions at any time without prior notice. Any alteration of these terms will be effective from the date and time of posting on Losoftware website. These terms and conditions will apply to your order once you have received your confirmation email and they will supersede any other terms and conditions in whatever form given. Please feel free to print and retain a copy of the terms and conditions.
